New L&I job site accommodations start July 1

Labor and Industries (LNI) is implementing HB 2266 requiring specific menstruation and lactation accommodations on construction sites. Members may remember that, in 2024, BIAW opposed the bill that created this new standard solely for construction. While it still passed, BIAW’s legislative team was able to pare the requirements down  to ensure compliance was not only possible, but easier than originally proposed. 

These standards go into effect July 1, 2025. Here are some tips to make this transition smoother: 

1. Have a no-cost supply of menstruation products available in women’s and gender-neutral bathrooms. These do not have to be brand or type specific, however tampons or pads are generally preferred. You can also provide them in kits on the jobsite.   

2. Ensure that the toilet is equivalent in size to the average standard portable toilet and has a working lock. 

3. Provide for flexible breaks and adequate time for pumping breast milk and allow for adequate time to accommodate multiple layers of clothing for both pumping and menstruation.  

4. Have a clean cooler with ice packs available for storage of breast milk—or you may also provide plugged-in refrigeration.  

5. Accommodate a location for pumping breast milk. It must be private, not a restroom, and lockable. This  could be a vehicle with window shades.   

6. Have potable water to wash hands and clean pumping equipment.
