The Washington State Supreme Court has scheduled oral argument in the case challenging the constitutionality of Initiative 2066 for the morning of Jan. 22, 2026.
Approved by nearly 2 million voters in November 2024, I-2066 protects natural gas as an energy choice in Washington state.
“Political efforts to ban natural gas in Washington limit homeowners’ choices, stress our energy grid and drive up the cost of utilities and housing for consumers,” said BIAW’s Executive Vice President Greg Lane. “That’s why we crafted I-2066 with a singular goal – preserving natural gas as an energy choice for current and future homeowners.”
A new opportunity to preserve energy choice
The Washington Supreme Court accepted direct review of the case on Sept. 3, 2025, and will consider the case “de novo,” meaning they will review the case on its merits without taking an earlier King County Superior Court decision into consideration.
“We’ve had to fight legal battles every step of the way, and we’re confident the Washington State Supreme Court will reject this latest challenge as the frivolous claim it is,” Lane said.
